Terms of Use

About these terms

These terms govern your use of the Thimarcom app, on the web and in any version of it. Thimarcom is provided by Nezir Alabsi, on behalf of the non-profit Thimarcom charity project (“we”). By using the app you agree to these terms. If you are a parent or guardian letting your child use the app, you are responsible for the child's use of it. Our Privacy Policy explains how data is handled.

The service

Thimarcom is a non-profit charity project, offered free to everyone for the sake of God, as an ongoing charity (sadaqah jariyah). It has no ads, no subscriptions and no in-app purchases, and it does not need an account. After it is first opened it works offline, except for recitations you have not downloaded, which need the internet, and it keeps your data on your device.

Ownership and permitted use

The Thimarcom software, including its source and compiled code, its design and its original lessons, is © Nezir Alabsi. All rights reserved. The reading-lesson recordings are used with the permission of the volunteer reciter who recorded them. The app is licensed to you, not sold.

You may use it free of charge for personal and family learning, and for teaching in mosques, Quran circles (halaqas) and schools, provided no one is charged for access to it.

What you may not do

To protect this charitable work from misuse and profiteering, without our written permission you may not:

• copy or modify the app or any part of its code or design;
• decompile or reverse-engineer it, except to the extent the law expressly allows despite this term;
• extract its original content (our lessons and recordings), re-host it, or frame it inside another website;
• redistribute it or publish it under another name or brand;
• sell or rent it, charge for access to it or bundle it in a paid product or service, and never add ads to it or exploit it commercially in any other way;
• build derivative apps or services from it;
• use it or its content to train machine-learning or artificial-intelligence models;
• alter the Quranic text or present it altered in any way.

If you would like to use it in another way, please write to us; we welcome any cooperation that serves the Book of God.

Third-party materials

The Quranic text, tafsir, recitations, tajweed data, classical texts, fonts and software libraries belong to their owners and are provided under their own licences and terms, listed in the “About” section of Settings. Nothing in these terms limits any right those licences give you.

Educational notice

• We prepare the lessons with care, strive for accuracy, and keep improving them.
• The app does not replace learning from a qualified teacher, and it is not a fatwa service. For questions about Islamic rulings, please ask qualified scholars.
• The Quranic text comes from the Tanzil project without any change. If you find a mistake in a text or a lesson, please tell us: support@ssk-appen.se

Volunteer contributions

If you record or review lessons and send us the files, you confirm that the work is your own and that you may share it, and you allow us to use it in Thimarcom free of charge, as agreed with you.

Your data and your device

Your data is kept only on your device, and we keep no copy of it, apart from any file you choose to send us. The browser or system may clear it, or it may be lost with the device, so save a backup regularly from the Family page. We cannot restore lost data.

Availability and changes to the service

We may add, change or stop features. Recitations come from EveryAyah.com, and their availability may change for reasons outside our control. We try to keep the app available, but we do not promise that it will work without interruption or errors.

Limitation of liability

• The app is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows.
• To the extent the law allows, we are not responsible for any indirect or consequential loss, or for the loss of data stored on your device.
• Nothing in these terms limits rights that cannot be waived under the law that applies to you, or any liability that cannot lawfully be limited.

Misuse

If you break these terms, for example by copying the app or profiting from it, your permission to use it ends immediately, and we may take any step the law allows to protect the project. You may stop using the app at any time and delete its data from your device.

App stores

If you get Thimarcom from an app store, that store's terms also apply (for example, Apple's standard licence agreement on the App Store), and they take precedence over these terms where required.

Governing law

These terms are governed by the laws of Sweden, and the courts of Sweden have jurisdiction over any dispute arising from them, without taking away any protection that the laws of your own country give you and that cannot be waived, or your right to bring a claim in the courts of your own country where the law guarantees it.

Changes to these terms

We may update these terms. When we do, we will change the “last updated” date at the top and point out important changes inside the app. If you keep using the app after that, you accept the updated terms.
